Terms & Conditions

▪️Unlimited Plan/Private Coaching

(1) Except as specifically set forth in this Agreement, all amounts paid or payable under this Agreement are non-refundable.

(2) AP Academy reserves the right to suspend, vary, or terminate the above offers and amend the above terms and conditions at any time. In the case of any disputes, AP Academy reserves the right of final decision.

(3) In case of any discrepancy between the English and Chinese versions of these terms and conditions, the English version shall prevail.

Suspension and Termination:

(4) I, the undersigned, hereby agree and acknowledge that AP Academy may suspend or terminate my membership at any time, in its sole and absolute discretion, for non-payment of Membership Fees or violation of any of AP Academy’s policies and procedures, and that in so doing, AP Academy assumes no further liability to adhere to the terms of this Agreement.

(5) I, the undersigned, hereby understand that I have the right to terminate my membership upon a termination fee of the equivalent of 2 months’ Membership Fee at any time during my contract.
The termination can be effective immediately at AP Academy’s sole and absolute discretion. I will not have to pay for the monthly fee onwards and AP Academy assumes no further liability to adhere to the terms of this Agreement.

After completion of the contract period:

(6) I, the undersigned, hereby agree and acknowledge that AP Academy will continue the membership monthly automatically at our prevailing membership fee.

(7) I, the undersigned, hereby understand that I have the right to terminate my membership at the end of or after the contract period upon not less than 14 days written application in advance.

(8) I, the undersigned, hereby understand that the promotional discount, if any, will be invalid if the requirements of the specific promotion are not met.

Extension of unused sessions:

(9) I, the undersigned, hereby understand that all subscribed private coaching sessions must be completed within the same month and any unused sessions will not be replaced. An administrative fee of HK$100 per session will be charged for the extension of overdue sessions.

(10) I, the undersigned, hereby understand that requests for an extension of overdue sessions must be made within the first week of the following month. Late requests will not be accepted and the overdue session will be deemed to have been forfeited. All postponed sessions must be arranged and conducted within the following month, and no further postponement will be allowed after the deadline.

Policy:

(11) I, the undersigned, hereby understand and agree to the Sign-in, Booking, Late Arrivals, Changes/Cancellations, Absence Policy, as seen in Appendix I.

Direct Marketing:

(12) The personal data provided by you through this Agreement may be used by Athletic Performance Academy Limited (AP Academy) and M2R Investment Limited (Art Piece) for processing applications, reviewing your package, benefits, or services, collection of Class Fees, Premium Locker fees, and other payments required under the Terms and Conditions. It may also be used for the operations of AP Academy and Art Piece for any related purposes, including direct marketing. If you do not wish to receive such communications, please indicate your preference by contacting our customer service team at any time.

(13) ⁠The personal data given by means of this Agreement may be disclosed to any member of AP Academy’s and Art Piece’s associated companies, any agent, contractor or person who provides administrative, telecommunications, marketing communication, computer and other services to AP Academy and Art Piece in connection with the operation of AP Academy’s business.

(14) ⁠You have a right of access and correction with respect to your personal data in accordance with the Personal Data (Privacy) Ordinance upon payment of a reasonable fee. Your right of access includes the right to obtain a copy of the personal data which you have provided by means of this Agreement.  

*Services Available with M2R Investment Limited and/or under the Business Name Art Piece*

Participants attending classes, treatments, or other activities at Art Piece’s locations, or those managed by M2R Investment Limited under the business name Art Piece, are also bound by Art Piece’s Terms and Conditions.

Appendix I

Sign-in, Booking, Late Arrivals, Changes/Cancellations, Absence Policy

Sign-in Arrangement

Each participant must sign in when he/she arrives at the studio. All sign-in records are based on the system data, and those who do not sign in will be regarded as absent.

Bookings

Classes are open for reservations from the earliest one week to the latest 2 hours before the class.

Late Arrivals

It is the responsibility of the participant to be on time for class and to reserve time for early use of the locker room and storage of personal belongings; no extra time will be given for late arrivals.

We reserve the right to prohibit late arrivals from entering the classroom to avoid delaying the progress of the class.

The studio makes every effort to provide class training on time. If a class cannot start as scheduled, the class will be postponed compensating for the delay.

Changes/Cancellations

Changes/cancellations must be made by logging into GYMMASTER or MINDBODY at least 6 hours before the class.

All change/cancellation requests made less than 6 hours before the class will not be accepted and will be treated as no-shows.

Please note that the studio does not accept changes/cancellations by any means other than the GYMMASTER or MINDBODY system. Any change/cancellation by phone, WhatsApp, message, email, fax, or verbal notification will not be considered valid.

We kindly request for your cooperation in canceling the booking as soon as possible to allow other students to make the reservation.

Absence

Credit Plan – Absentees’ booked class will considered as “used”, no make-up will be arranged, and any missed classes will not be carried over or refunded.

Unlimited Plan – Absentees will be charged with a penalty of HKD 50 per session in Art Piece or will not be allowed for booking at GYMMASTER for next day.

In case of bad weather or other reasonable circumstances, we will waive the above penalties.

A notification on the same day of the appointment and a valid doctor’s certificate are required in case of unwell and need to take sick leave.

Private Coaching – Absentees’ booked class will considered as “used”, no make-up will be arranged, and any missed classes will not be carried over or refunded.

In case of bad weather or other reasonable circumstances, we will waive the above penalties.

A notification on the same day of the appointment and a valid doctor’s certificate are required in case of unwell and need to take sick leave.

Others

Youth Athlete – Guardian Arrangements

The membership of Youth Athlete under the age of 16 must be held by his/her parent or guardian, and it is recommended that 1 adult should accompany each class.

Private Coaching – Assigned Coaches

All Private Coaching are followed up and trained by a professional coaching team, no designated coach will be assigned.

▪️Open Gym

Only active account members will be allowed entry.

Pre-approved AP Academy members under the age of 18 must be accompanied by an approved member parent until they reach the age of 18.

Improper unauthorized use of the Gym may result in member suspension or cancellation.

The Gym reserves the right to suspend or cancel the rights, privileges and membership of any member whose actions are detrimental to the use, safety, and enjoyment of the Gym.

Do not bring or otherwise allow a person that is not an approved member or guest of the Gym to access the facility without permission.

Do not bring or otherwise allow a person younger than 18 years of age to access the Gym without permission.

Athletes alone in the Gym should call 999 in case of an emergency.

No one under the influence of alcohol or drugs is permitted in the Gym at any time. No alcohol-involved fitness activities are permitted without permission from the owner.

Only use equipment you understand how to use.

Inspect the equipment to make sure it is properly functioning prior to using the equipment.

Remove any potential trip hazards from the floor, around racks/lifting area, and return all excess plates/equipment to keep area tidy when they are not in use.

Limit all movements to 80% loading during non-staffed hours.

Stop exercising if you experience a potential injury and seek medical attention.

Inspect your surroundings to make sure equipment and weights are not obstructing your intended exercise.

Notify management and all other members using the Gym if any equipment is not working properly or if you notice any potentially dangerous conditions within the Gym.

Return all equipment, and/or other Gym supplies to their designated storage place after using the equipment and pick up any items or trash brought into the Gym or bathrooms.

After Gym use, please vacuum, mop, and wipe down any used equipment.

The Gym is monitored by surveillance cameras. Do not touch, move, or unplug any security cameras.

Turn off all lights and air-conditioning in the Gym when you leave.

Be sure to firmly push the door closed and check to make sure it’s locked!

No Supervision

I understand this service allows you to access to our studio in non-peak hours. As such, I am aware that there will be no supervision or assistance except during staffed hours. Staffed hours may change at the sole discretion of the Gym. I am aware if I get injured, become unconscious, suffer a stroke or heart attack or any other medical emergency or event, there will likely be no one to respond to my emergency and that the Gym has no duty to provide assistance to me while I am at the Gym. I understand even though the Gym is equipped with surveillance cameras, these record, but are not monitored continuously; help will not be available during non-staffed hours.

Acknowledgement of Risk and Waiver of Liability

I voluntarily assume the risk of injury, accident, death, loss, cost or damage to my person or property which might arise from my use of the Gym, and I agree to hold harmless and release the Gym and all affiliated corporations, and its owner, directors, employees, representatives, management, and all others from any and all liability. You also release all of those mentioned and any others acting on their behalf from any responsibility or liability for any injury or damage to myself including those caused by the negligent act or omission of any of those mentioned or others acting on their behalf or in any way arising out of or connected with my participation in any activities or the use of any equipment at the gym during staffed or non-staffed hours.

I certify that I have read and understand all of the terms of the gym agreement and agree to continue to abide by all of the terms of this agreement.

General Terms

This contract represents the complete understanding between you and the Gym. No representations, written or oral, other than those contained in this contract (and the Gym’s other waivers) are authorized or binding upon the Gym. Should any part of this agreement due to legal or other regulatory changes become unenforceable, the remaining provisions within this agreement not impacted by such change shall remain in full force as originally written. You agree to promptly update the Gym of any changes of address, phone, email address and/or bank account/credit card information.

I certify that I have read and understand all of the terms of the gym agreement and agree to continue to abide by all of the terms of this agreement.
